Terms of Service
Last updated October 24, 2026
Welcome, and thank you for your interest in Angelo Lamonaca (sole proprietorship), operating as Neuramare (“Neuramare,” “we,” “us,” or “our”) and GenVista — our website at https://www.genvista.com, along with our related applications and services (collectively, the “Service”). These Terms of Service (“Terms”) are a legally binding contract between you and Angelo Lamonaca regarding your use of the Service.
PLEASE READ THE FOLLOWING TERMS CAREFULLY. BY ACCESSING OR USING THE SERVICE, YOU AGREE THAT YOU HAVE READ AND UNDERSTOOD, AND, AS A CONDITION TO YOUR USE OF THE SERVICE, YOU AGREE TO BE BOUND BY, THESE TERMS. IF YOU ARE NOT ELIGIBLE, OR DO NOT AGREE TO THE TERMS, THEN YOU DO NOT HAVE OUR PERMISSION TO USE THE SERVICE.
Our Privacy Policy explains how we handle personal data. It is information for you and is not part of these Terms.
ARBITRATION NOTICE FOR USERS IN THE UNITED STATES. IF YOU LIVE IN THE UNITED STATES, THEN EXCEPT FOR CERTAIN KINDS OF DISPUTES DESCRIBED IN THE DISPUTE RESOLUTION SECTION BELOW, YOU AGREE THAT DISPUTES ARISING UNDER THESE TERMS WILL BE RESOLVED BY BINDING, INDIVIDUAL ARBITRATION, AND BY ACCEPTING THESE TERMS, YOU AND ANGELO LAMONACA ARE EACH WAIVING THE RIGHT TO A TRIAL BY JURY OR TO PARTICIPATE IN ANY CLASS ACTION OR REPRESENTATIVE PROCEEDING.
Service overview
GenVista is a studio for generating images, short videos and music with open-weight AI models, on the web and, for creating and editing pictures, in the GenVista Pictures app for iPhone, iPad and Android. Users may select checkpoints and LoRAs — including models sourced from third-party libraries such as CivitAI — submit prompts and reference inputs, and generate media on GPU infrastructure we rent and run. Access is offered through subscription plans that set generation cadence and queue limits. The wait after an image also depends on the GPU time it uses: quality boosts, and the first image with a model not yet loaded on our GPUs, make it longer, and the Service shows the wait before you start a job. The Service uses third-party AI systems and infrastructure to generate images, video, and related media from user prompts and inputs.
Eligibility
You must be at least 18 years old to use the Service. By agreeing to these Terms, you represent and warrant that: (a) you are at least 18 years old; (b) you have not previously been suspended or removed from the Service; and (c) your registration and use of the Service complies with all applicable laws and regulations. If you are an entity, the individual accepting these Terms represents that they have authority to bind you.
The Service is offered from Switzerland. Some features, plans and prices depend on where you are, and visitors from some countries are sent to the version of the Service offered there. We make no representation that the Service is appropriate or available for use in every jurisdiction. You are responsible for complying with the laws that apply to you where you use the Service.
Accounts
To access most features, you must register for an account. You agree to provide accurate information and keep it up to date. You are solely responsible for maintaining the confidentiality of your account and for all activity under your account. Notify us immediately at support@genvista.com if you believe your account is no longer secure.
Additional terms
Your use of the Service is also subject to our Community Guidelines and DMCA Policy (together, the “Additional Terms”), which are incorporated into these Terms by reference.
User content
Generally
Certain features permit users to submit, upload, or otherwise make available (“Post”) content to the Service, including prompts, reference images, clips, songs, voice recordings and other inputs, model selections, and generated images, videos and songs you save (“User Content”). You retain any copyright and other proprietary rights you may hold in User Content you Post, subject to the licenses granted in these Terms.
License to Neuramare
By Posting User Content to or via the Service, you grant Neuramare a worldwide, non-exclusive, royalty-free, fully paid right and license, with the right to sublicense it to the service providers that run the Service for us, to host, store, transfer, reproduce, modify for formatting purposes, process with AI models to create the output you ask for, check as described under “How we moderate content”, and display and deliver to you your User Content, as needed to operate, provide, secure and improve the Service, to comply with the law, to enforce these Terms, and to protect the Service, our users and others. This license lasts for as long as we hold your User Content under these Terms and our Privacy Policy.
Representations and warranties
You must not Post User Content if you are not the owner of, or fully authorized to grant rights in, all elements of that User Content. Neuramare disclaims any and all liability in connection with User Content, to the fullest extent permitted by law. You are solely responsible for (i) your User Content and the consequences of Posting it, and (ii) all license terms related to User Content — including the license terms of any third-party model you select. By Posting User Content, you affirm, represent, and warrant that:
- you are the creator and owner of the User Content, or have the necessary licenses, rights, consents, and permissions to authorize Neuramare and users in the manner contemplated by these Terms;
- your User Content, and the Posting or other use of your User Content as contemplated by these Terms, does not and will not infringe, violate, misappropriate, or otherwise breach any third-party right, including copyright, trademark, patent, trade secret, moral right, privacy, publicity, or other proprietary right; slander, defame, or invade the privacy or publicity rights of any person; or cause Neuramare to violate any law or pay royalties, fees, or other amounts to third parties; and
- your User Content could not be deemed by a reasonable person to be illegal, objectionable, or in violation of our Community Guidelines.
User content disclaimer
We are under no obligation to edit or control User Content that you or other users Post and, to the fullest extent permitted by law, will not be in any way responsible or liable for User Content. Neuramare may, however, screen, remove, edit, or block any User Content that in our judgment violates these Terms or the law, is alleged to violate the rights of third parties, or is otherwise objectionable under our Community Guidelines, as described under “How we moderate content”. You understand that when using the Service you may be exposed to User Content from a variety of sources and acknowledge that User Content may be inaccurate, offensive, indecent, or objectionable. To the fullest extent permitted by law, you agree to waive, and do waive, any legal or equitable right or remedy you have or may have against Neuramare with respect to User Content. This waiver does not apply to consumers living in the European Union, the European Economic Area, the United Kingdom or Switzerland.
AI-generated content
Output generated through the Service is produced by automated systems based on your inputs. Such output may be inaccurate, inconsistent, unexpected, offensive, or similar to third-party works. You are solely responsible for reviewing, using, and publishing AI-generated output. We do not warrant that generated content is original, non-infringing, suitable for any purpose, or free of errors. Third-party models you select may carry their own license terms; you are responsible for complying with them. You must not rely on the Service for legal, medical, financial, or other professional advice.
Marks that say the content is AI-generated. Pictures, videos and songs you make with the Service generally carry machine-readable marks: a signed label in the file (C2PA Content Credentials, with matching IPTC metadata) and an invisible watermark in the pixels, frames or sound. They say that the content was made with AI, by GenVista, and how (from a description or from your own file); the label also names the tool, the model and the time. They never identify you. Tools that only change your own file without making anything new, such as splitting a song into its parts, add no marks. Anyone can check a file on our Check a file page.
If you publish content that shows real people, objects, places or events and could falsely appear to be authentic (a “deep fake”), you must disclose that it was generated or manipulated with AI wherever the law requires it, including under Article 50(4) of the EU AI Act.
Third-party models and services
The Service lets you use models, catalogs and other content provided by third parties, such as CivitAI, and relies on third-party services to operate. We do not control them and, to the fullest extent permitted by law, are not responsible for their content, availability, accuracy or license terms, or for any loss arising from your use of them. A model may be removed or stop working at any time.
Content retention and deletion
The Service is a workbench, not a storage, archival, or backup service. Generated images, videos and songs, the source files you upload for a generation, and the corresponding entries in your queue and history are retained for 48 hours from the time the generation is created, and are then deleted automatically and permanently from our systems. Deletion is irreversible: we cannot restore content once the retention window has elapsed, and we keep no backup copies for you.
You are solely responsible for downloading and keeping your own copies of any output you wish to retain, and for doing so within that window. You may also delete your generations yourself before it elapses: they leave your account at once and are erased when the window ends. We do not guarantee that any User Content will remain available for the full 48 hours, and we may remove content sooner where necessary to operate the Service or to comply with law, these Terms, or our Community Guidelines. We may keep content longer where the law requires or permits it, for example to handle a report, to comply with a legal obligation, or to establish, exercise or defend legal claims. We may change the retention window as described in the Changes section; the window currently in effect is stated here, in the Service, and in our Privacy Policy.
Prohibited conduct
By using the Service, you agree not to:
- use the Service for any illegal purpose or in violation of any law;
- Post User Content prohibited by our Community Guidelines;
- harass, threaten, demean, embarrass, bully, or otherwise harm any user;
- infringe or misappropriate any third-party intellectual property or other right;
- access the Service through unauthorized automated means (bots, scrapers, crawlers) except as we expressly authorize;
- interfere with security or operation of the Service, including distributing malware, attempting unauthorized access, or circumventing rate limits, queue caps, or content safeguards;
- impersonate any person or entity or misrepresent your affiliation;
- deliberately remove, alter, obscure, forge, or otherwise tamper with the marks in content made with the Service (its Content Credentials, metadata, or invisible watermark), as described under AI-generated content;
- use the Service to train competing models without our written permission; or
- assist or permit any person to engage in the foregoing.
How we moderate content
We have no general obligation to monitor User Content or third-party content on the Service. We do check content, as described below, for operational, legal and safety reasons. Even when we do, we assume no responsibility for User Content and no liability for any loss resulting from its use, to the fullest extent permitted by law. We may block, filter, remove, or disable access to User Content as this section describes, without liability to the posting user or any other user, to the fullest extent permitted by law. We may report illegal content to authorities and cooperate with law enforcement.
Our rules. These Terms, our Community Guidelines and the law.
Automated checks. Jobs pass automatic checks before and after the GPU works on them. Which checks run depends on the tool and the job. They can include:
- Prompt filters: words that our rules don't allow are refused, in your prompt, in song lyrics and in text our AI writes for a job.
- Picture classifiers: a classifier reads uploaded and generated pictures, and frames of clips, and refuses sexual content or nudity our rules don't allow.
- The under-18 age gate: realistic pictures and clip frames, uploaded or generated, are checked for people who may be under 18. A face detector finds faces and age models estimate how old each person looks. Drawings are checked for characters who may be children. The gate estimates apparent age only. It does not identify anyone.
- Real-person checks: where a job could show a real person in a way our rules forbid, we check prompts against a list of well-known people's names, check whether a chosen model is marked as showing a real person or a minor or carries a real person's name, and check whether an upload shows a realistic face.
- Our blocklist: uploads are compared with fingerprints of uploads we refused before.
A check that finds a problem refuses the job: nothing is made, or the result isn't saved. Automated checks can be wrong; see “Refusals, suspensions and how to contest them” below.
Abuse detection. Some refusals, such as those for content that may show a minor or that our rules forbid about real people, are recorded against the account. For some kinds of jobs, our system counts an account's recorded refusals, and past set limits it restricts the affected features of the account automatically until the account has been reviewed.
Human review. Single jobs are refused by the automated checks. We may review reports, requests for review and accounts flagged by abuse detection, and we may restrict, suspend or close an account by hand.
What we can do. Depending on what happened and how serious it is, we can:
- refuse a job;
- remove or disable access to content;
- limit features or lower an account's limits;
- suspend part or all of the Service for an account, for a set time or until we have reviewed it;
- close an account; and
- report to the authorities (see “Suspected serious crimes”).
Reporting content. Report content you believe is illegal or breaks our rules to abuse@genvista.com. A notice should explain why you consider the content illegal, identify it as exactly as you can (for example by its job number or address), give your name and email address (not required for child sexual abuse material), and confirm that you believe in good faith that the notice is accurate and complete. Where the law requires it, we confirm receipt and tell you our decision. Copyright notices go to dmca@genvista.com, as our DMCA Policy describes.
Refusals, suspensions and how to contest them
Where the law requires it, we tell you the reasons for a decision to refuse a job, remove or restrict your content, or restrict, suspend or close your account, and how you can contest it. For a refused job, the message in the studio names the check that refused it. We may withhold or delay information where the law requires or allows it, for example when an authority asks us to.
To contest a decision, write to support@genvista.com from your account's email address, saying which decision you mean and why you think it is wrong. For a refused job, write within 48 hours if you can, while the job still exists. We will review your request. This does not affect any right you may have to take the matter to court.
Suspected serious crimes
If we become aware of information giving rise to a suspicion that a criminal offence involving a threat to the life or safety of a person has taken place, is taking place or is likely to take place, we may inform, and where the law requires it will inform, the competent law enforcement or judicial authorities, and give them the relevant information we have. Where the law requires or permits it, we may keep the content and data concerned beyond the 48-hour window, for as long as the authorities need it, and we may suspend the account concerned.
Subscriptions and billing
Access to generation features requires a paid subscription. Plans bought on the website are billed in advance through our payment processor (Stripe) on a monthly or yearly cycle and renew automatically until canceled. You can cancel them at any time through the billing portal; cancellation takes effect at the end of the current billing period, and you keep access until then. A plan bought in the GenVista Pictures app is billed by Apple (App Store) or Google (Google Play) under their terms: you manage and cancel it in your App Store or Google Play subscription settings, refund requests for it go to Apple or Google, and it can't be changed on the website while it is active. Where offered, trials — free, or with a one-time trial fee charged when the trial starts — convert to a paid subscription unless canceled before the trial ends. Trials are for new members only, one per person and payment method: a trial started with a card or payment account that has already had one is canceled at once and any trial fee refunded. Each plan carries usage limits (such as generation cadence and queue caps, and a longer wait after an image that uses more GPU time), which we may adjust to protect the Service. Prices may change with prior notice; changes apply from your next billing cycle, and you can cancel before they do. Except where required by law, payments are non-refundable.
If you dispute a payment for a plan with your bank or card issuer (a chargeback), every plan you hold on the website ends at once. Winning or withdrawing the dispute does not restore it; you can subscribe again.
Right of withdrawal for consumers in the EU, the EEA and the UK
If you are a consumer living in the European Union, the European Economic Area or the United Kingdom, you have the right to withdraw from a plan bought on our website within 14 days without giving any reason. The withdrawal period ends 14 days after the day the contract is concluded, which is the day you subscribe or start a trial. To exercise the right of withdrawal, use “Withdraw from contract here” in Plan & billing, shown there while the withdrawal period lasts, or inform us of your decision by another clear statement, for example an email to support@genvista.com. You may use the model withdrawal form below, but it is not obligatory. To meet the withdrawal deadline, it is sufficient for you to send your notice before the withdrawal period has expired. We confirm a withdrawal by email.
Starting at once. A plan starts as soon as you subscribe, so before checkout you ask for this by ticking “Start my plan now”. If you then withdraw, you pay for the days you used, as set out below.
Effects of withdrawal. If you withdraw, the plan ends at once, and we will reimburse all payments received from you for that plan without undue delay and in any event not later than 14 days from the day we are informed of your decision. We will use the same means of payment you used, unless you have expressly agreed otherwise; in any event, you will not incur any fees as a result of the reimbursement. If you requested that the Service begin during the withdrawal period, you shall pay us an amount in proportion to what has been provided until you informed us of your withdrawal, compared with the full coverage of the contract.
Model withdrawal form (complete and return it only if you wish to withdraw): To Angelo Lamonaca, operating as Neuramare, Am Rainbach 22, 6340 Baar, Zug, Switzerland, support@genvista.com: I hereby give notice that I withdraw from my contract for the provision of the following service: [plan]. Ordered on [date]. Name: [name]. Email address of the account: [email]. Date: [date].
Nothing in these Terms limits the rights that mandatory consumer law gives you.
Intellectual property
The Service, including its software, branding, and design (excluding User Content), is owned by Angelo Lamonaca or its licensors. Except as expressly authorized, you may not copy, modify, distribute, or create derivative works of the Service.
If you believe content on the Service infringes your copyright, see our DMCA Policy.
Feedback
If you provide suggestions or feedback about the Service (“Feedback”), you grant Neuramare an unrestricted, perpetual, irrevocable, non-exclusive, fully paid, royalty-free license to use the Feedback for any purpose without attribution or compensation.
Termination
You may stop using the Service at any time. We may suspend or terminate your access to the Service at any time if you break these Terms or the law, where the law requires it, or where we consider it necessary to protect the Service, other users or third parties, as described under “How we moderate content”. We may also discontinue the Service or end your account for any other reason, with reasonable notice and to the extent permitted by applicable law; in that case we refund the unused part of any prepaid period of a plan bought on our website. Upon termination, you must cease use of the Service. You are solely responsible for retaining copies of User Content you wish to keep. If your account is terminated for breach, you may not create a new account without our permission. Provisions that by their nature should survive termination will survive, including User Content licenses, disclaimers, indemnification, limitation of liability, and dispute resolution.
Indemnification
To the fullest extent permitted by law, you are responsible for your use of the Service, and you will defend and indemnify Angelo Lamonaca and our affiliates, suppliers, and service providers (together, the “Neuramare Parties”) from and against every claim brought by a third party, and any related liability, damage, loss, and expense, including attorneys' fees and costs, arising out of or connected with:
- your unauthorized use of, or misuse of, the Service, including User Content of other users;
- your User Content or any AI-generated output you use or publish;
- your violation of any portion of these Terms or applicable law;
- your violation of any third-party right, including intellectual property, privacy, or publicity rights; or
- any dispute or issue between you and any third party.
We reserve the right, at our own expense, to assume the exclusive defense and control of any matter subject to indemnification by you, and you agree to cooperate with our defense. If you are a consumer living in the European Union, the European Economic Area, the United Kingdom or Switzerland, this section applies only to the extent the claim results from your culpable breach of these Terms or the law.
Disclaimers
THE SERVICE AND ALL MATERIALS AND CONTENT AVAILABLE THROUGH THE SERVICE ARE PROVIDED “AS IS” AND ON AN “AS AVAILABLE” BASIS. THE NEURAMARE PARTIES DISCLAIM ALL WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, QUIET ENJOYMENT, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS, OR THAT USER CONTENT OR AI-GENERATED OUTPUT WILL BE ACCURATE OR NON-INFRINGING.
NO ADVICE OR INFORMATION OBTAINED FROM THE SERVICE WILL CREATE ANY WARRANTY NOT EXPRESSLY STATED IN THESE TERMS. YOU USE THE SERVICE AT YOUR OWN RISK. WE ARE NOT RESPONSIBLE FOR ANY DAMAGE FROM YOUR USE OF THE SERVICE OR YOUR DEALINGS WITH OTHER USERS.
If you are a consumer, these disclaimers apply only to the extent permitted by the mandatory law that applies to you.
Limitation of liability
TO THE FULLEST EXTENT PERMITTED BY LAW, IN NO EVENT WILL THE NEURAMARE PARTIES BE LIABLE TO YOU FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES (INCLUDING DAMAGES FOR LOSS OF PROFITS, GOODWILL, DATA, OR ANY OTHER INTANGIBLE LOSS) ARISING OUT OF OR RELATING TO YOUR ACCESS TO OR USE OF, OR INABILITY TO ACCESS OR USE, THE SERVICE, USER CONTENT, AI-GENERATED OUTPUT, OR THIRD-PARTY SERVICES, WHETHER BASED ON WARRANTY, CONTRACT, TORT, OR ANY OTHER LEGAL THEORY, EVEN IF WE HAVE BEEN INFORMED OF THE POSSIBILITY OF DAMAGE.
TO THE FULLEST EXTENT PERMITTED BY LAW, THE AGGREGATE LIABILITY OF THE NEURAMARE PARTIES TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THE SERVICE OR THESE TERMS IS LIMITED TO THE AMOUNT YOU HAVE PAID TO US FOR ACCESS TO THE SERVICE IN THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM.
EACH PROVISION THAT PROVIDES FOR A LIMITATION OF LIABILITY, DISCLAIMER OF WARRANTIES, OR EXCLUSION OF DAMAGES IS INTENDED TO ALLOCATE RISKS BETWEEN THE PARTIES. THIS ALLOCATION IS AN ESSENTIAL ELEMENT OF THE BASIS OF THE BARGAIN BETWEEN THE PARTIES.
Where the law that applies does not allow a limitation or exclusion of liability, for example for intent or gross negligence, that limitation or exclusion applies only to the extent that law allows.
If you are a consumer living in the European Union, the European Economic Area, the United Kingdom or Switzerland, the two paragraphs in capitals above do not apply to you, and instead: we are liable without limitation for intent and gross negligence, for injury to life, body or health, and where mandatory product liability law applies; for slight negligence, we are liable only for breach of an obligation essential to the contract, and only up to the damage typical and foreseeable when the contract was made.
Dispute resolution and arbitration
This section applies only if you live in the United States.
Generally
Except as described in Exceptions below, you and Angelo Lamonaca agree that every dispute arising in connection with these Terms, the Service, or communications from us will be resolved through binding arbitration. Arbitration uses a neutral arbitrator instead of a judge or jury, is less formal than court, and is subject to very limited court review. This agreement includes all claims whether based in contract, tort, statute, fraud, misrepresentation, or any other legal theory.
Exceptions
Nothing in these Terms limits the right of either party to:
- bring an individual action in small claims court;
- pursue an enforcement action through a government agency;
- seek injunctive relief in court in aid of arbitration; or
- file suit to address an intellectual property infringement claim.
Opt-out
If you do not wish to resolve disputes by binding arbitration, you may opt out within 30 days after you first agree to these Terms by sending a letter to Angelo Lamonaca, Attention: Arbitration Opt-Out, Am Rainbach 22, 6340 Baar, Zug, Switzerland, or email to legal@genvista.com, specifying your full legal name, the email associated with your account, and a statement that you wish to opt out of arbitration.
Arbitrator and rules
This arbitration agreement is subject to the Federal Arbitration Act and will be administered by the American Arbitration Association (“AAA”) under its Consumer Arbitration Rules, as modified by these Terms. AAA rules are available at adr.org.
No class actions
YOU AND ANGELO LAMONACA AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS OR REPRESENTATIVE PROCEEDING. The arbitrator may not consolidate claims or preside over any class proceeding.
Governing law and courts
These Terms are governed by the laws of Switzerland, without regard to conflict-of-law principles, except that the Federal Arbitration Act governs arbitration. If arbitration does not apply, subject to mandatory consumer law, the exclusive place of jurisdiction is the ordinary courts of the Canton of Zug, Switzerland.
If you are a consumer, this choice of law does not deprive you of the protection of the mandatory laws of the country where you live, and you may also bring a claim in the courts where you live where that law allows it.
International use
The Service is run from Switzerland and hosted in the United States, with service providers and rented GPU machines in other countries, as our Privacy Policy describes. We make no representation that the Service is appropriate or available for use outside your jurisdiction. Access from territories where such access is illegal is prohibited. You are responsible for compliance with local law.
Changes
We may change these Terms for valid reasons, such as changes in the law, in the Service or in what it costs us to run, or to protect the Service and its users. We will inform you of significant changes, for example in the Service or by email, at least 30 days before they take effect, unless a change is required by law or is only in your favour. If you do not agree, you can stop using the Service and end your plan before the change takes effect. If you continue to use the Service after that, the changed Terms apply to you.
General
If any provision of these Terms is held invalid or unenforceable, it applies to the fullest extent permitted, and the remaining provisions stay in full force. Our failure to enforce a provision is not a waiver of it. We may assign or transfer these Terms, in whole or in part, in connection with a sale, merger or reorganization of the business; you may not assign them without our written consent. We are not liable for any delay or failure to perform caused by events beyond our reasonable control, including failures of third-party infrastructure or service providers. These Terms, together with the Additional Terms, are the entire agreement between you and us about the Service. If we provide a translation of these Terms, the English version prevails.
